Privacy Policy for HomeView Lending

1. Introduction

This Privacy Policy explains how HomeView Lending ("HomeView Lending," "we," "us," or "our") collects, uses, shares, and protects personal information in connection with our website at [WEBSITE URL] (the "Site") and the related advertising, lead-intake, and mortgage origination services we provide.

HomeView Lending is an independent mortgage team led by David Herrera, Mortgage Loan Officer, NMLS #2311843. We originate residential mortgage loans under our sponsoring brokerage, America's Best Lending (Company NMLS #1936058), and are based in Houston, Texas. HomeView Lending currently conducts mortgage activities only in the State of Texas, and we accept and service loan inquiries only from consumers seeking to finance residential property in Texas. While America's Best Lending is licensed in additional states, the mortgage services offered by HomeView Lending and described on this Site are available only in Texas.

HomeView Lending is the business responsible for this Privacy Policy and for the personal information described in it.

By using the Site or submitting information through it, you acknowledge that you have read and understood this Privacy Policy.

2. Scope of This Policy

This Policy applies to personal information we collect:

a. Through the Site, including our pre-screening qualification form;

b. Through advertising we run on third-party platforms (for example, Meta/Facebook and Instagram ads) that direct you to the Site;

c. By telephone, email, or text message in connection with an inquiry you submit; and

d. From third parties, as described in Section 3.

This Policy does not cover the separate privacy practices of third parties, including advertising platforms, lenders, or other websites that may be linked from the Site. It also does not, by itself, replace any separate privacy notice provided to you by America's Best Lending or by a lender during a formal loan application.

3. Categories of Information We Collect

3.1 Information You Provide to Us

When you complete our pre-screening qualification form or otherwise contact us, we may collect:

  • a. Identifiers and contact information — your name, telephone number, email address, and the U.S. state in which you are located or intend to purchase or refinance property;

  • b. Borrower pre-screening information — your driver type (for example, owner-operator status), length of time in business / business tenure, self-reported credit score range, FHA loan status or interest, down-payment range, and your anticipated purchase or refinance timeline;

  • c. Communications — the content of messages, emails, voicemails, and text messages you send to us, and your contact preferences;

  • d. Any other information you choose to provide during a call, consultation, or follow-up.

3.2 Information We Collect Automatically

When you visit the Site, we and our service providers and advertising partners may automatically collect:

  • a. Device and connection data — IP address, browser type, operating system, device identifiers, and language settings;

  • b. Usage data — pages viewed, links clicked, referring and exit pages, the date and time of your visit, and how you interact with our forms;

  • c. Advertising and analytics data — information collected through cookies and similar technologies, including the Meta Pixel and Google Analytics 4, as described in Section 6.

3.2 Information We Collect Automatically

We may receive information about you from:

  • a. Advertising platforms (such as Meta and Google), which may tell us how you found the Site and how our ads performed;

  • b. Our sponsoring brokerage and wholesale lenders, in connection with evaluating or processing a loan inquiry;

  • c. Service providers that support our marketing, lead management, and communications.

4. How We Use Your Information

We use personal information to:

  • a. Respond to your inquiry and contact you about mortgage products and services, including the truck-driver mortgage program advertised on the Site;

  • b. Pre-screen and evaluate whether you may qualify for a loan program and route your inquiry appropriately;

  • c. Schedule, confirm, and follow up on appointments and consultations, including by SMS text message (see Section 7);

  • d. Communicate with you by phone, email, and text;

  • e. Prepare for and support a potential mortgage loan application with America's Best Lending and one or more wholesale lenders;

  • f. Operate, maintain, secure, and improve the Site and our services;

  • g. Measure and improve the performance of our advertising, including through the analytics and pixel technologies described in Section 6;

  • h. Detect and prevent fraud, and protect the safety, rights, and property of HomeView Lending, our customers, and others;

  • i. Comply with applicable laws, regulations, licensing obligations, and lawful requests from government authorities; and

  • j. Maintain records and otherwise carry out our legitimate business operations.

We do not use your information for purposes that are materially different from those described here without providing notice or obtaining consent where required by law.

5. How and With Whom We Share Information

We do not sell your personal information for money, and we do not disclose your personal information to third parties so they can market their own products and services to you. We disclose personal information only with the following categories of recipients, and only as needed for the purposes described in this Policy — that is, to the service providers, sponsoring brokerage, and lenders involved in operating our business and handling your mortgage inquiry:

  • a. Our sponsoring brokerage — America's Best Lending. As the brokerage that sponsors our mortgage license, ABL receives information necessary to supervise our activities and to originate, process, and underwrite loan files.

  • b. Wholesale mortgage lenders. When you pursue a loan, we share information with one or more wholesale lenders so they can evaluate, underwrite, and (if approved) fund a loan.

  • c. Our affiliated in-house tax professional. We may share information with an affiliated tax professional who works with our team to help evaluate your income or tax situation as it relates to a potential loan.

  • d. Service providers. We use third-party service providers to operate our business, including GoHighLevel, which provides our customer relationship management (CRM), lead-management, and SMS messaging platform. Service providers are permitted to use your information only to provide services to us.

  • e. Advertising and analytics partners. We share certain online activity data with Meta (Facebook/Instagram) and Google through the technologies described in Section 6, for advertising measurement and audience purposes.

  • f. Legal, safety, and compliance recipients. We may disclose information to comply with law, regulation, subpoenas, court orders, regulator or licensing-authority requests, or to protect rights, safety, and property, and to enforce our agreements.

  • g. Business transfers. If HomeView Lending is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction, subject to applicable law.

6. Cookies, Meta Pixel, and Google Analytics

6.1 What We Use

The Site uses cookies and similar tracking technologies, including:

  • a. Essential cookies, which are needed for the Site to function;

  • b. Analytics technologies — Google Analytics 4 (GA4), which help us understand how visitors use the Site; and

  • c. Advertising technologies — the Meta Pixel, which helps us measure the performance of our Meta (Facebook/Instagram) ads and reach relevant audiences.

These technologies may collect device data, usage data, and information about your interactions with the Site, and may share that data with Meta and Google as described in Section 5.

  • a. Device and connection data — IP address, browser type, operating system, device identifiers, and language settings;

  • b. Usage data — pages viewed, links clicked, referring and exit pages, the date and time of your visit, and how you interact with our forms;

6.2 Your Choices and Opt-Out Guidance

You can manage these technologies in several ways:

  • a. Browser controls. Most browsers let you block or delete cookies through their settings. Blocking some cookies may affect how the Site works.

  • b. Google Analytics opt-out. You can opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on, available from Google at THIS LINK.

  • c. Meta ad preferences. You can review and adjust the ads you see and how Meta uses your activity through the ad settings in your Facebook or Instagram account.

  • d. Industry opt-out tools. You can opt out of certain interest-based advertising through the Digital Advertising Alliance (optout.aboutads.info) and the Network Advertising Initiative (optout.networkadvertising.org).

  • e. Global Privacy Control. Where required by law, the Site is configured to recognize and honor opt-out preference signals such as the Global Privacy Control (GPC). See Section 10.

7. SMS / Text Messaging

With your consent, we send SMS text messages — such as appointment reminders and follow-ups about your mortgage inquiry — through GoHighLevel. Our messaging program is registered under the A2P 10DLC framework. Consent to receive text messages is not a condition of any purchase or of obtaining any service from us. Your mobile opt-in information and consent are not shared with third parties for their own marketing purposes. 8. Data Retention

We keep personal information only as long as reasonably necessary for the purposes described in this Policy, including to respond to your inquiry, to support a potential or actual loan, to comply with legal, regulatory, licensing, and recordkeeping requirements, to resolve disputes, and to enforce our agreements. When information is no longer needed, we take steps to delete, de-identify, or securely archive it.

Our general retention period for Site lead and inquiry data is five (5) years, after which we delete, de-identify, or securely archive that information, unless a longer period is required by law or by our sponsoring brokerage's recordkeeping requirements.

9. GLBA Privacy Notice (Financial Privacy)

Because our business involves helping consumers obtain residential mortgage loans, we handle nonpublic personal information ("NPI") and our activities are subject to the federal Gramm-Leach-Bliley Act ("GLBA") and its implementing regulations.

We conduct mortgage activities under our sponsoring brokerage, America's Best Lending ("ABL"), which maintains the GLBA privacy program for our mortgage operations and delivers the formal GLBA privacy notice you receive in connection with a loan application. The GLBA notice provided to you by ABL is the controlling financial-privacy notice. This Section is an informational summary only; it does not replace ABL's notice, and if there is any conflict, ABL's notice governs.

9.1 Information We Collect

The NPI we collect may include:

  • a. Information you give us on applications, forms, or in communications (for example, contact details and the pre-screening information described in Section 3.1);

  • b. Information about your transactions with us, our sponsoring brokerage, or others; and

  • c. Information we receive from third parties, including consumer reporting agencies and lenders, in connection with a loan inquiry or application.

9.2 Information We Disclose

We may disclose all of the NPI categories described above to the categories of recipients listed in Section 5, including our sponsoring brokerage, wholesale lenders, our in-house tax professional, and service providers, as permitted by law.

  • a. Browser controls. Most browsers let you block or delete cookies through their settings. Blocking some cookies may affect how the Site works.

  • b. Google Analytics opt-out. You can opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on, available from Google at THIS LINK.

9.3 Sharing and Your Right to Opt Out

We disclose NPI primarily to process and complete transactions you request — for example, providing your information to a lender so it can underwrite the loan you applied for — and to the sponsoring brokerage, service providers, and other recipients described in Section 5. We do not disclose NPI to third parties for their own marketing. Federal law permits the disclosures described in this Policy, and any opt-out rights that apply are described in the GLBA privacy notice provided to you by America's Best Lending.

9.4 How We Protect NPI

We maintain physical, electronic, and procedural safeguards designed to protect NPI, as further described in Section 11. We restrict access to NPI to personnel and service providers who need it to perform their duties.

9.5 Former Customers

We continue to apply these privacy practices to NPI about former customers and former inquiries for as long as we retain that information.

10. Your California Privacy Rights (CCPA/CPRA)

This Section applies to California residents and is provided under the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA/CPRA").

Important interaction with GLBA. Personal information that is collected, processed, sold, or disclosed under the GLBA and its implementing rules is generally exempt from the CCPA/CPRA. As a result, much of the mortgage-related information we handle may fall outside these California rights. The rights below apply to California personal information that is not GLBA-exempt — for example, certain Site visitors' online activity and advertising data.

10.1 California Consumer Rights

Subject to the GLBA exemption and other exceptions, California residents may have the right to:

  • a. Know / access the categories and specific pieces of personal information we have collected, the sources, the purposes, and the categories of recipients;

    b. Delete personal information we have collected, subject to exceptions;

    c. Correct inaccurate personal information;

    d. Opt out of the "sale" or "sharing" of personal information (see Section 10.2);

    e. Limit the use of sensitive personal information, where applicable; and

    f. Non-discrimination — you will not be denied service, charged a different price, or given a different level of service for exercising these rights.

10.2 Do Not Sell or Share My Personal Information

We do not sell your personal information for money. However, our use of advertising technologies such as the Meta Pixel may be considered a "sale" or "share" of personal information for cross-context behavioral advertising under California law, because online identifiers and activity data may be disclosed to advertising partners.

California residents have the right to opt out of this activity. To opt out:

  • a. Submit a request by emailing us at [email protected] or by using the other contact methods in Section 12;

  • b. Use an opt-out preference signal. We honor the Global Privacy Control (GPC) and similar signals for the browser and device on which they are enabled; and

  • c. Adjust cookie and advertising settings as described in Section 6.

10.3 Authorized Agents

You may use an authorized agent to submit a request on your behalf. We may require the agent to provide proof of authorization and may require you to verify your identity directly.

10.4 Other U.S. State Privacy Rights

Residents of certain other states may also have privacy rights (for example, rights to access, correct, delete, or opt out of targeted advertising) under their own state laws. Although HomeView Lending originates loans only in Texas, the Site's advertising may reach residents of other states, and those states' privacy laws can apply based on where a consumer resides.

11. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, loss, or disclosure. These measures may include access controls, encryption in transit, vendor due-diligence, and staff training. We also rely on the security programs of our service providers, including GoHighLevel.

No method of transmitting or storing information is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your own devices and accounts secure and for the information you choose to send us.

13. Children's Privacy

The Site and our services are intended for adults and are not directed to children under 18 years of age. We do not knowingly collect personal information from anyone under 18. If you believe a minor under 18 has provided us with personal information, please contact us using the information in Section 12, and we will take appropriate steps to delete it.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date above and, where required by law, provide additional notice. Material changes will be posted on the Site. Your continued use of the Site after an update means you accept the revised Policy.
